Please read these Terms of Service carefully before using Ploto. By creating an account or using the Service in any way, you enter into a binding agreement with Ploto. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

1. Acceptance of Terms

By accessing or using Ploto at heyploto.com (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Service. These Terms apply to all visitors, registered users, and paying subscribers.

2. Description of Service

Ploto is an AI-powered data visualisation tool that allows you to upload tabular data files (CSV, Excel) and generate charts automatically. The Service is provided on a subscription basis with a free tier and a paid Pro tier. Feature availability varies by plan as described on our pricing page.

3. Accounts and Registration

To use the Service you must create an account using a valid email address. You are responsible for:

  • Providing accurate and up-to-date registration information.
  • Keeping your password confidential and not sharing access with others.
  • All activity that occurs under your account, whether or not authorised by you.

You must be at least 16 years old to create an account. By registering, you confirm that you meet this requirement.

4. Acceptable Use

You agree not to use the Service to:

  • Upload, transmit, or process any content that is unlawful, harmful, defamatory, or that violates the rights of any third party.
  • Upload data that you do not own or do not have the legal right to process.
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service.
  • Use automated tools, scripts, or bots to scrape, crawl, or extract data from the Service without our express written permission.
  • Use the Service, or any part of it, as the basis for building a product or service that competes directly with Ploto.
  • Interfere with or disrupt the integrity, performance, or security of the Service or its underlying infrastructure.
  • Attempt to gain unauthorised access to any other user's account or data.

We reserve the right to investigate suspected violations and take appropriate action, including account suspension or termination.

5. Intellectual Property

Your content: You retain full ownership of all data files you upload and all charts and outputs generated through your use of the Service. By uploading content, you grant Ploto a limited, non-exclusive, royalty-free licence to process and store that content solely for the purpose of providing the Service to you. We do not claim any ownership over your data or outputs.

Our content: The Ploto name, logo, software, and all related intellectual property are owned by Ploto and are protected by applicable laws. Nothing in these Terms grants you any right to use our branding or intellectual property without our prior written consent.

6. Subscriptions and Billing

Ploto offers a free tier and a paid Pro subscription. Billing for the Pro plan is handled by our third-party payment processor, which acts as the Merchant of Record. By subscribing, you agree to their terms of service and authorise recurring charges to your chosen payment method.

Cancellation: You may cancel your Pro subscription at any time from your account settings. Upon cancellation, you will retain access to Pro features until the end of your current billing period, after which your account will revert to the free tier. No partial refunds are issued for unused time within a billing period.

Refunds: All payments are non-refundable. If you experience any difficulty cancelling your subscription or have a billing concern, please contact us at info@heyploto.com and we will work to resolve the issue promptly.

We reserve the right to change our pricing with reasonable advance notice. Continued use of the Service after a price change takes effect constitutes your acceptance of the new pricing.

7. Suspension and Termination

Termination for violation: We may suspend or terminate your account immediately and without prior notice if you breach these Terms or engage in conduct that we determine, in our sole discretion, is harmful to other users, the Service, or Ploto.

Termination without cause: We may terminate your account for any other reason by providing:

  • Free accounts: 7 days' written notice to the email address associated with your account.
  • Pro accounts: notice no later than the end of your current paid billing period, during which you will retain full access to the Service.

You may terminate your account at any time by deleting it from your account settings or by contacting us at info@heyploto.com. Upon termination, your data will be deleted in accordance with our Privacy Policy.

8. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any AI-generated chart will be accurate or suitable for your specific needs.

AI-generated charts and visualisations are produced algorithmically and should be reviewed before use in any professional, academic, or commercial context. Ploto is not liable for decisions made based on chart outputs.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Ploto shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. In no event shall our total liability to you exceed the amount you paid to Ploto in the twelve months preceding the claim, or USD 50 if you are a free-tier user. Nothing in these Terms limits liability that cannot be excluded under applicable consumer protection law.

10. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Kingdom of Bahrain, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Bahrain.

If you are located in the European Union, nothing in these Terms affects your rights as a consumer under the mandatory consumer protection laws of your country of residence.

11. Changes to These Terms

We may revise these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. For material changes, we will notify you by email or via a prominent notice within the app at least 7 days before the changes take effect. Your continued use of the Service after that date constitutes your acceptance of the revised Terms.
